Terms and Conditions

If you wish to book a PRIVATE RENTAL VEHICLE or TAXI (TAXI), tick the box “I accept the terms and conditions of Cabra” on the passenger contact page of the website. This website cannot accept PRIVATE CAR RENTAL or TAXI (TAXI) bookings if you do not agree with our terms and conditions. Whenever you make a reservation on behalf of someone else, make sure you click “I accept Cabra’s Terms and Conditions” so that you can be sure you have the authority to do so. Listed below are the definitions for the terms that are used in these Terms and Conditions: “Agreed Pickup Location” refers to the place where you will be picked up by PHO.

  1. Meanings

2.1. the following expressions shall have the following meanings:

a.”Personal Information” refers to your name, address, email address, phone number, and credit card information.

b.”Terms” cover Cabra Cab’s terms and conditions.

c.”PHO” stands for the private hire company or taxi company with which you reserve.

d.”Reserve” a taxi service online. Reservations can be made for one-way, round-trip, or partial trips.

e.”Website” consists of Cabra’s public website cabracabit.com and mobile social media applications.

f.”PHO-AGB” refers to the PHO’s general terms and conditions, which are applicable to the booking and (the trip).

g.”Agreed Time” is when PHO will pick you up, according to the details you provided.

h.”Card” means a credit card, debit card, store card, or PayPal account.

i.”Details” include pickup and delivery times, the pickup address, and your personal information.

j.”Fee” represents the amount you paid to accept the Offer.

k.”Goods” are any items transported in a taxi booked online.

l.”Special Requirements” concerning disabled facilities and drivers’ gender.

m.”Card Fees” are charged when you pay for your trip with a credit card or PayPal.

n.”Trip” describes the route from your pickup address to your destination address.

o.”Licensing Authority” means any authority issuing licenses for the operation of private rental vehicles or taxicabs.

p.”Passenger” means anyone traveling in a taxi booked through this website.

q.”You” is the person who enters the details.

r.”Cab” refers to pre-booked taxis (hackneys) or rental cars (cars).

s”Offer” means the trip offered on the website.

  1. Website Use

3.1. If you create a booking through this website, you will be required to provide us with accurate information, and you will be responsible for any mistakes that are made.

3.2. There is no need for Cabra to act as an Operator, since Cabra is responsible for reserving the delivery carrier for PHO, not acting as an operator.

3.3. The settlement for the availability of the delivery carrier takes place between You and PHO, notwithstanding clause 3.6.

3.4. If you choose to have more than one PHO provide your Trips within the Booking, the provision of the delivery carrier for each Trip within the Booking must be settled immediately between you and the PHO that you have chosen.

3.5. It is your responsibility to confirm that you are over the age of eighteen and legally capable of making a Booking by making the Booking.

3.6 Cabra does not now guarantee that it’ll be able to satisfy Your needs and reserves the right to refuse any Bookings that You desire to make and to cancel any Bookings that You have made at any time. In the event such a thing happess, Cabra will reimburse you for the full cost you paid for the use of You, and this is the final agreement on all claims you may have against them.

3.7. Through the use of Cabra, You can record Your Details and Your Website use. You will, however, not be permitted to share or use your Personal Data for any other purpose besides the availability of the offerings in accordance with this agreement, subject to the Cabra Privacy Policy.

3.8. Goat may send you a small document when You visit the website. This cookie will allow Cabra to track Your behavior on the website and identify unique areas of interest that will enhance Your future visits.

3.9. Using this cookie, Cabra will no longer be able to identify You, and Cabra will not use it to do anything other than this website’s purposes. It is possible to disable cookies on your computer, but some Website functions may not be available if you do so. You may also be requested by a government authority or regulation enforcement agency to disclose Your Personal Data if required by law.

3.10. Cabra’s mailing list can be unsubscribed by sending an email to [email protected] with the subject “unsubscribe.”

  1. Conducts

4.1. The PHO has the right to terminate the Trip at its own discretion if you or your celebration behaves in a disruptive way and/or impacts your safety or the safety of the driver. In the event that you or your celebration incur any additional fees as a result of using you, the PHO will not be held legally responsible.

4.2. The consumption of alcoholic liquids during a trip is not permitted in automobiles.

4.3. If PHO believes that a person is under the influence of alcohol or drugs, they may refuse to transport them.

  1. Insurance

5.1. If any damage or loss occurs to such Goods during the course of a Trip, it is your sole responsibility to make sure they are insured in case of damage or loss. Neither Cabra nor PHO are responsible or insured against any such loss or damage.

  1. Liability Limitation and Warranty

6.1. Cabra has been assured that PHO is certified by the correct licensing authority(ies). Private Hire or Taxi Operator, however, can no longer be held responsible for verifying such assurance, so if you are uncertain, please contact them and trust their personal verification.

6.2. We won’t be held responsible for delays in pickups or drop-offs or for PHO’s failure to deliver according to Your expectations.

6.3. In the event of any failure to use PHO, or any failure related to those Terms, or in any other way related to them, Cabra (whether in the agreement or in any other circumstance) does not have to pay any oblique loss, consequential loss, or loss of revenue, however arising, that has occurred as a result of using You. If you recall having any claim against PHO based on any failures you experienced using PHO, you should make a claim as soon as possible.

6.4. If any claim arises out of those Terms (whether in contract or tort), Cabra’s combined liability will be £500.

6.5. If there is not an express warranty clause stated in those Terms, all implied warranties and conditions, as well as different phrases are excluded from these Terms to the extent legally permissible.

6.6. There are no limitations that apply to PHO’s legal responsibility for death or non-public damage caused by its negligence. Nothing in this clause is intended to exclude any other rights that you might have under the general terms and conditions of your contract with PHO.

6.7. As a general rule, it would be a good idea to take any estimated ride times or arrival times shown on Cabra’s Public web page or from any other source as being indicative only and not as being based on visitors, weather conditions, or the most recent route taken by the driver.

6.8. Consequently, it is your responsibility to make sure that the time agreed upon gives you enough time to arrive at the vacation destination, check-in for the flight, take a train, or satisfy any other demands you may have during the vacation.

6.9. To keep you informed of the status of your Booking, Cabra may send you email and SMS textual content alerts, even though Cabra cannot guarantee the delivery or timing of these alerts, and Cabra shall no longer be liable for indirect, consequential, or revenue losses (whether in the agreement or otherwise). However, arising from the omission or delay of such electronic mail and SMS text messages.

6.10. A separate and severable provision is provided for each of the foregoing subclauses in this clause. These provisions will, however, continue to apply regardless of termination, final touch, or any other circumstance that could otherwise result in termination or ineffectiveness of those Terms.

  1.  Refund, Booking and Cancellations

7.1. When you make a booking through the website, you have the right to cancel it.

7.2. If you wish to cancel a Booking, you can do it by contacting Cabra through the Contact Us page on the website and quoting the booking reference as specified on the website in order to do so.

7.3. It is possible to cancel a Booking under Clause 7.1 above if it occurs before the cancellation deadline indicated on the reservation confirmation page and email, which is earlier than the cancellation deadline. It is possible to receive a full refund (excluding any charge associated with your credit card) if you paid by credit card.

7.4. You will not receive a refund if you cancel your booking after the cancellation reduction time indicated on the confirmation page and confirmation email, and you will not receive a refund if you paid by credit card, and you will be marked as such if you paid by cash, so you will be unable to make another reservation with Cabra in the future.

7.5. The cancellation fee may be refunded to you for automobiles carrying nine or more passengers up to one week (until otherwise specified on your confirmation email and reservation webpage) before the agreed time for all automobiles carrying nine or more passengers. You might be eligible for a full refund (minus any card charges) if you paid with a credit card.

7.6. For all automobiles with nine or more passengers (until otherwise specified), if you cancel in less than one week, you will not receive a refund if you paid by credit card earlier than the agreed time, unless otherwise indicated on the confirmation page and your reservation confirmation email.

7.7. You may be entitled to a full refund of the Fare as well as any Card Charges if PHO does not show up at the agreed-upon pickup point within 15 minutes of the agreed-upon time, but you do not use PHO for your trip. You agree to any claim you may have as a result of such failure in this document.

7.8. Nevertheless, you will not be eligible for a refund if, at your discretion, you decide to continue the trip with the PHO arriving after 15 minutes.

7.9. When you do not show up at the agreed pickup point within 15 minutes of the agreed pickup time, the PHO may treat your non-availability as a cancellation, and you will no longer be entitled to any refunds or card charges.

7.10. If the PHO arrives more than 15 minutes past the agreed-upon time, they might charge you additional costs. If this happens, you will be able to pay the added charges at the same time.

7.11. If your bank or credit card issuer allows refunds for pre-paid bookings between three and five business days after the date of the booking, the refund can be applied to the credit card used to make the payment (business days are Monday through Friday).

  1. Exclusions and Limitations

8.1. PHO will no longer transport or carry the following:

8.2. Items or belongings (of any kind) which have a value of over £50 (cash, securities, precious metals, furs, jewelry, etc.) are considered valuable.

8.3. Any product that is hazardous, dangerous, inflammable, explosive, or noxious, as well as any product that is unlawful to own, is considered illegal under the current English Law.

8.4. A variety of items (of any kind) may also go to pot if they are transported in a particular manner.

8.5. In terms of this agreement, PHO does not accept any responsibility in any way whatsoever for any loss or harm that may arise from clause 10.1.

8.6. There can be no further liability on the part of PHO for any of the following at any time or in any manner whatsoever, regardless of whether it occurs immediately or in a circular manner:

8.7. Whether they occur simultaneously or in a circuitous manner, PHO shall no longer be liable for any of the following:

8.7.1. Any loss, damage, or breakage to fragile objects caused by PHO’s actions, omissions, negligence, or any other cause.

8.7.2. Aside from the general provisions of clause 10.1, PHO is no longer responsible for the following losses or damages:

8.7.3 Accidents, breakdowns, and damaging climate conditions.

8.7.4 The Customer’s actions or omissions.

8.8. There may be clauses, acts or situations beyond the control of PHO (including, without limitation, strikes, (reputable or now no longer) lock-outs, any sort of business movement or labour disputes, government regulations, prison restrictions, embargos, fire, flood, Act of God, any effect of riots, battles, invasions, acts of overseas enemies, It does not matter if a war is declared or not, hostilities can occur (whether or not a war has been declared or not), civil war, terrorism, rebellion, navy power, confiscation, requisition or destruction of property, or damage to property with the aid of or upon the order of a government authority or public neighborhood authority, or other situations that constitute force majeure.).

8.9. A loss or damage to items or belongings is covered under clause 10.1 and 11.1 but not the liability for death or private injury arising from these items or belongings.

  1. Disputes

9.1. Whenever you have a complaint about the PHO provider, you should first contact PHO directly (by teletext or email) to resolve it as soon as possible.

9.2. It is your responsibility to inform Cabra within 72 hours of the agreed upon time if you are not able to resolve your concerns with PHO through the Contact Us web page or via email at [email protected] if you are not able to resolve your concerns with PHO. Failure to comply with any of these requirements will invalidate any other claim you may have.

9.3. Consequently, if Cabra is unable to resolve any claim on its own, it is also possible for you to also appreciate the service provided by PHO to the mutual satisfaction of both you and PHO if Cabra is unable to resolve any claim on its own. This claim will be submitted by Cabra in accordance with the willpower of impartial 1/3 birthday celebrations determined by Cabra, and You will be assured that by choosing these 1/3 birthday celebrations you will be certain.

 

9.4. If you have a dispute with the PHO, Cabra is not liable for any claims, needs, or damages (real or consequential).

 

  1. PRIVACY POLICY

10.1. In the process of creating a Booking, Cabra will collect and manage your Personal Data in a confidential manner. These details will not be shared with 1/3 of events without your consent. Cabra may amend this Privacy Policy as well as post such changes publicly on the website.

  1. Miscellaneous

11.1. This agreement shall constitute the entire settlement between the parties and supersede all previous agreements and any representations made by either party, whether orally or in any other way, including by way of written documents (except as expressly preserved in this agreement).

11.2. You warrant that your decision to proceed has not been influenced by any illustrations provided by Cabra.

11.3. No failure on the part of either party to put in force any appropriate declaration or provision thereof or to bobbing up hereunder shall be construed as a waiver of such declaration or provision.

11.4. Cabra will receive all notices from its Customers, unless otherwise specified, via email sent to [email protected].
